Waiver of High School Unit Instructional Time

North Dakota Century Code 15.1-06-08 - Waiver. A district/school may apply to the superintendent of public instruction for permission to alter the amount of instructional time per unit required by NDCC Chapter 15.1-21-03 and stated in North Dakota Administrative Code 67-19-02. In order to be approved, the waiver must encourage innovation, improve educational opportunities for students, or enhance academic opportunities for students.

Due Dates - Prior to the school year for which the reconfigured school calendar is being sought:
- Initial applications must be received by March 1
- Extension applications must be received by July 1

Section 2: Justification for Wavier Request
1. Please provide a detailed account of the waiver requested and the reasons for the waiver. Include relevant educational research and trends related to student outcomes to support the request. Please describe how these opportunities would be more readily available with a waiver of instructional unit time. Please also include a school calendar and high school class schedule.
2. Provide a written statement of the mission of philosophy, the goals and the objectives of the school, and how the waiver of high school unit instructional time will support the statement and enhance student learning. In order to be approved, the proposal must include a detailed description showing that it: (1) encourages innovation; and (2) has the potential to result in improved educational opportunities or enhance academic opportunities for students. Please include as much information as possible to show that the proposal would positively impact student outcomes.
Section 3: Evaluation Plan

Explain specific plans to evaluate topics in Section 3.
3a. How will student academic performance be measured under the waiver proposal? How will student data be used to determine if the waiver proposal is positively impacting student outcomes? What changes, if any, will occur as a result of the waiver of instructional time?
3b. How will the waiver proposal encourage innovation? What additional initiatives or programs will be implemented and how will teachers develop and use innovative means of instruction. Please include information regarding relevant educational trends and research as well as how the school district will determine the success of the innovation. Please also include information regarding how a waiver of instructional time will allow for greater innovation and success than what would be expected without the waiver.
3c. How will the waiver proposal improve or enhance educational and academic opportunities for students? Include opportunities that are currently available, as well as additional opportunities that that are expected to be available under the proposal to waive instructional time. Please also include information to explain how these opportunities would be more readily available with a waiver of instructional time than it would be without the waiver. Information submitted may include opportunities related to the long-term outcomes in the North Dakota PK-12 Education Strategic Vision Framework. This may include opportunities to increase the number of students who graduate Choice Ready and/or opportunities intended to reduce the disparity in achievement for students with disabilities, students in poverty, and Native American students.
Section 4: Request for Extension Waiver

Please only fill out Section 4 if requesting an extension to an existing waiver.
4. If you are requesting an extension to a waiver that was previously granted, please include a school calendar and a class schedule for the upcoming year. Please also provide evidence of: (1) innovation occurring because of the waiver; or (2) enhanced educational/academic opportunities provided to students because of the waiver. Please include in your evidence as much information as possible to demonstrate positive student outcomes that occured as a result of the waiver of instructional time. Information submittted may include opportunities related to the long-term outcomes in the North Dakota PK-12 Education Strategic Vision Framework. This may include opportunities intended to increase the number of students who demonstrate reading proficiency in third grade, opportunities intended to increase the number of students who demonstrate math proficiency in eighth grade, opportunities intended to increase the number of students that meet the expected learning gains each year, opportunities intended to increase the number of engaged students in the student engagement survey, opportunities intended to increase the number of students that graduate Choice Ready, and/or opportunities intended to reduce the disparity in achievement for students with disabilities, students in poverty, and Native American students.
